Tinjauan Hukum Adat terhadap Perkawinan Semarga dalam Masyarakat Batak Mandailing di Tanah Rantau (Studi di Kecamatan Tambusai Kota Pasir Pengaraian)
The Mandailing community uses a patrilineal kinship system, which recognizes and uses clan as a group term. Mandailing society adheres to an exogamous marriage system, therefore marriage within the same family according to Mandailing customary provisions is prohibited. Recently, more and more marriages have been performed only in Islamic ways. especially if the gifts and ceremonies stipulated by customary law are too burdensome for the person concerned. The main problem in this research is how is the implementation of samemarriage in the Mandailing Batak community in Tanah Rantau (in Tambusai District, Pasir Pengaraian City) What are the legal consequences of same-marriage in the Mandailing Batak Community in Tanah Rantau (in Tambusai District, Pasir Pengaraian City). The research method used is empirical, this research is descriptive in nature, and the data collection tool in this research is through interviews regarding the implementation of same-marriage marriages in the Mandailing Batak Community in Tanah Rantau (in Tambusai District, Pasir Pengaraian City). The implementation of clan marriages carried out in Tambusai District, Pasir Pengaraian City is the same as that carried out in the Mandaling community in general, the difference is only in the customary court to determine the customary sanctions against perpetrators of clan marriages which are carried out at the manulak sere stage. Factors that influence marriages of the same surname in the Batak Mandailing community in the land of exile are caused by love factors, religious factors, economic factors and educational factors. Marriages of the same surname in the Batak Mandailing community in the land of exile are carried out because the people in the Tambusai sub-district of Pasir Pengaraian city no longer believe in taboos.
