Tanggungjawab Hukum Terkait Alih Fungsi Hutan Lindung Menjadi Kebun Kelapa Sawit di Kabupaten Rokan Hilir
In Law Number 41 of 1999 concerning Forestry, in Article 19, the term transfer of function is known as a change in the designation and function of a forest area. Changes in the designation of forest areas occur through the process of exchanging forest areas and releasing forest areas. The transfer of forest area functions, which occurs through changes in the designation of forest areas, is focused on supporting interests outside of forestry (agriculture, plantations, transmigration, regional development, mining and other non-forestry issues). Forest area conversion can also be done through changes in forest function but without reducing the forest area area, for example for forestry development purposes (conservation of natural/plantation forest areas, educational/research forests). The background to writing this thesis was the large number of environmental cases that were resolved at the Rokan Hilir District Court, where most of the plaintiffs were environmental foundations that sued several people or companies that used forest land as their business premises. The existence of this environmental case in court indicates that there is a mismatch between existing regulations and events in the field so that there are parties who feel disadvantaged. Based on the description outlined in the background of this paper, the problem of this paper can be formulated as follows: 1). What is the legal responsibility from a civil perspective towards the parties involved in converting protected forests into oil palm plantations in Rokan Hilir Regency? 2). What is the role of the government and community in enforcing the law regarding the conversion of protected forests into oil palm plantations in Rokan Hilir district. This type of research is sociological normative legal research, namely a research typology that combines normative research with observational research. This research is descriptive analysis, namely describing the current state of the subject or object of research based on facts that appear as they really are. From the research conducted it can be concluded that; Legal responsibility from a civil perspective towards parties involved in the conversion of protected forests into oil palm plantations in Rokan Hilir Regency is in accordance with what is regulated in the Job Creation Law that the Central Government, Regional Government, Communities and Community Organizations are responsible for this protected forest conversion activity. It is hoped that the role of the government and community in enforcing the law regarding the conversion of protected forests into oil palm plantations in Rokan Hilir Regency can be carried out in accordance with the mandate given in the Job Creation Law regarding forestry.
