Pelaksanaan Hukum Perkawinan Adat Melayu pada Masyarakat Adat Melayu di Kampung Adat Lubuk Jering Kecamatan Sungai Mandau Kabupaten Siak
This research is motivated by the fact that the preservation of customs in Lubuk Jering Village has not been carried out optimally, this can be seen from the Malay marriage customs which are currently very rarely used by indigenous people in the Lubuk Jering traditional village. In its implementation, customary law in this customary village still seems to have obstacles in the application of the marriage law of indigenous peoples. This can be seen from the clarity of customary law in the Lubuk Jering customary village whether this customary marriage law also applies to immigrant communities or not. In this research, the author discusses the main problems as follows: how is the implementation of malay customary marriage law in the malay traditional community in the Lubuk Jering traditional village, Sungai Mandau subdistrict, siak regency, what are the obstacles to malay customary marriage law in the Lubuk Jering indigenous community Sungai Mandau subdistrict Siak regency. The research method that the author uses in this research is the empirical legal research metod or sociological legal research. This research was carried out in field research where the author immediately went out into the field to obtaininformation and research materials or accurate data in identifying research objects directly with the relevant agencies. In the Lubuk Jering traditional village Sungai Mnadau subdistrict Siak regency. The results of the research obtained by the author are that the implementation of traditional malay marriages as a cultural heritage needs to be preserved by teaching it to the younger generation, so that the values in malay marriage customs contained therein can also continue to grow and be passed on to the next generation so that they continue to implement the rules. How a malay marriage should be carried out, for example in the stages of merisik,proposing marriage, sending a sign not to leave, each of these stages has its own meaning for the malay community. The inhibiting factors that become obstacles in the implantation of the malay customary marriage process are obstacles from an economic perspective, in terms of time, and inther-ethnic marriages. These obstacles result in the malay community’s marriage process experiencing elements of change in each marriage process. The impact of changes in malay marriage customs on the malay community itself, malay people will not know what the marriage customs of malay society were in ancient times because the malay marriage customs used today are malay marriage customs that have changed.
