Muhammad Ridwan - Personal Name; Abd. Thalib - Personal Name;

The background of this research is that recently on several e-commerce marketplace sites in Indonesia new marketing methods have been discovered, business actors sell their products but do not tell consumers exactly what products they will get, while the information provided is only limited to the type of product. such as electronics, clothing, or other types. This buying and selling practice is known as mystery box. The purpose of this research is to examine the practice of buying and selling mystery boxes and the legitimacy of purchasing and selling mystery boxes transaction agreements on ecommerce platforms from the legal aspect of agreements in Indonesia. The validity of agreements in mystery box buying and selling transactions can be fulfilled if assessed through subjective conditions but not can be fulfilled if seen through objective conditions, including a certain cause and a halal clause. The purpose of purchasing and vending in ecommerce mystery box transactions platforms is not clear what goods are being offered by business actors to their consumers. From the background, the author can formulate two main problems, first, How is the practice of buying and selling mystery boxes on e-commerce platforms linked to the principle of good faith. secondly, how is the validity of the mystery box related to Article 1320 of the Civil Code. The research methods used by researchers are normative and empirical research methods with primary data, conducting interviews with mystery box sellers and buyers. Secondary uses books and legal literature that are directly related to the research object. Analyze data qualitatively and draw inductive conclusions. Regarding the results of the research and discussion that the researchers found: Firstly, in mystery box practice, the principle of good faith has a very important (fundamental) role in making an agreement, including in online buying and selling agreements in order to minimize the possibility of fraudulent practices occurring in online buying and selling transactions. Second, the validity of the agreement in the mystery box buying and selling transaction on the e-commerce platform is invalid because it does not meet objective legal requirements which has the implication that the agreement made by the business actor and consumer is null and void.
