Nurul Insani - Personal Name; Zulkarnaini Umar - Personal Name;

Marriage according to syara' marriage is a handover contract between a man and a woman with the aim of mutually satisfying each other and to form an ark of a sakinah household and a prosperous society. One of Allah's instructions in Islamic law is that he is commanded to marry and that adultery is forbidden. The marriage order is one of the implementations of the five maqashid sharia, namely hifzhulnasl (keeping offspring). The formulation of the problem in this research are: (1) How is the Implementation of One Tribal Marriage in Minangkabau Indigenous Peoples in Jorong Padang LawasNagariSolok Bio-Bio, Harau District, Lima Puluh Kota Regency and (2) What is the view of Islamic law on the prohibition of single-tribe marriages in indigenous peoples? Jorong Padang LawasNagariSolok Bio-Bio, Harau District, Fifty City District, West Sumatra. The author uses empirical or sociological legal research methods, namely direct field research. The nature of this research is descriptive, that is, it provides an overview and analyzes statements clearly and in detail. Data collection tools through interviews and observations. In this field study, the data is then analyzed using qualitative methods with the method of drawing conclusions used is deductive. Where sasuku marriage in Minangkabau custom is not a problem in Islam itself, but is only prohibited by Minangkabau custom. With this, the community does not care about customary norms regarding sasuku marriage. Because of that thought, at this time there are still Minangkabau people who violate this customary rule, not only ordinary people who do it, there is even a cleric who does this sasuku marriage. Based on the results of the study that the implementation is not in accordance with Islamic law because in the Qur'an and hadith there is no prohibition on the marriage of one tribe. Where Sasuku marriage is a marriage that is prohibited in Minangkabau customs because the Minangkabau people consider people who are Sasuku to be people of one blood according to Matrilineal, Sekaum, even though they are from different villages but have the same tribe, they are still considered one blood.
