Pertanggungjawaban Serta Akibat Hukum Terhadap Akta Notaris Berdasarkan Keterangan Palsu Oleh Penghadap (Studi pada Wilayah Hukum Pekanbaru)
The services of a notary public are among the necessities for the community, and they are directly tied to each party's provision of trust., where this trust makes the notary carry out every interest submitted to him as a form of responsibility for his authority. People prefer to bind themselves in written agreements, especially in the form of authentic deeds because written agreements have strong and perfect evidentiary power. Drawing on the previously mentioned details, the author outlines the formulation of issues in this research, including the legal ramifications of deeds executed on the basis of incorrect information and the notary's accountability for executing deeds based on false information provided by the confrontant. In this research the author uses the type of sociological or empirical research, namely the author goes directly to the field with the interview method. This study is characterized by its descriptive analytical nature. namely providing a description accompanied by systematic, factual and accurate explanations. The results of this study show that the important role of Notary in creating legal certainty and legal protection for the community. However, in practice, Notaries are often involved in legal cases, this is because during the making of authentic deeds, there are actions taken on the basis of false statements or information that can harm one of the parties to the agreement. As a result, Notaries are often sued for damages but this cannot be justified if the Notary is held liable for the implementation of a false lawsuit because the Notary as a public official authorized to make an authentic deed only pours out what the parties state to him, not on the information or statement of the Notary himself.
