Gojek is an electronic application that distributes services in Indonesia and provides many benefits. One of them is opening up opportunities foreveryone to join to become work partners, in which there is a partnership agreement that is carried out between PT. Go-Jek which is non-binding or biyasa also known as daily workers who are binding in nature where drivers do not get rights decent as employees in general. The problems in this research are as follows first, what is the position of the e-contract in the partnership agreement between PT.Application Karya Anak Bangsa and drivers as providers of transportation services. Second, what is the process of fulfilling rights between PT.Application Karya Anak Bangsa and drivers as providers of transportation services The research method used is observation research by means of surveys, namely research directly in the field with information gathering techniques carried out by collecting data in the form of questionnaires and interviews. The method of drawing conclusions is inductively from the specific to the general. Based on the results of the research and discussion that the authors found, firstly, to bring the position of the e-contract, the partnership agreement must be agreed upon by the parties because it is considered valid and has legal certainty because it is regulated in Article 18 of Law No. 11 of 2008 concerning informqwi and electronic transactions. Second, the rights and obligations of work partners for gojek drivers do not get proper rights like work employees in general where when the drivers carry out orders in the event of an accident, PT.Go-Jek does not provide insurance and also the drivers do not get salary every month, PT. Go-Jek can carry out unilateral termination of employment at any time.
