The money comes from contributions from each insurance company that is managed for use if one day there is one insurance company that went bankrupt. Based on this background, The legal problem in this research is what is the urgency of establishing an institution policy guarantor as guarantor of the company's insurance customer's rights in bankruptcy insurance and what is the Legal Protection of the Insured on life insurance versus not payment of claims by the insurance company. The aim of this thesis research is to determine the urgency of formation policy insurance agency as an effort to provide legal protection for the insured in insurance lives whose claims have not been paid and know the legal protection of the insured life insurance against non-payment of claims by the insurance company. The research method used in this research is juridical research empirical. The data sources used are primary data and secondary data. Procedure data collection or data collection, namely document study and interviews. Data analysis used is qualitative analysis. The results of the research, firstly, based on the discussion, can be concluded: that The urgency for establishing a Policy Guarantee Agency is when the insurance company experienced bankruptcy which resulted in the company no longer being able to operate pay its debts to its creditors, there are institutions that guarantee funds the insured or guarantor of the policy so that the rights of the policy holder are protected. Basically The banking industry has an insurance Deposit Guarantee Institution, too has been mandated by the Insurance Law. Form of Legal Protection for the Insured life insurance against non-payment of claims by the insurance company The insured can take legal action in the form of a lawsuit through court or settle through the existing mechanisms in the life insurance policy.
