Pelaksanaan Larangan Perkawinan Sesuku Dalam Adat Melayu Petalangan Dikabupaten Pelalawan Ditinjau Dari Prespektif Hukum Islam
The provisions regarding marriage have been regulated in detail in the
rules of Islamic law, but this is contrary to the rules of customary law which in
Islamic law there is no prohibition on ethnic marriage but in customary law there
are its own rules regarding marriage. So that there are many problems that arise
regarding the prohibition of same-sex marriage, such as the indigenous Malays of
Petangan in Pelalawan District, Base Kuras District, Kemang Village.
In this case, the formulation of the problem in this research is how the
implementation of tribal marriage in the Malay Petalawanan custom in Pelalawan
Regency and how is the view of Islamic law on the prohibition of ethnic marriage
in the Malay Petalawan custom in Pelalawan Regency.
This research is a sociological juridical approach that is taken from
primary data by conducting interviews and secondary data and reviewing directly
to the field by processing data from primary legal materials, secondary legal
materials and tertiary legal materials.
The results of this study are that in Islamic rules there are no rules
prohibiting ethnic marriage as conveyed by the Islamic Ulema Council (MUI) in
Pelalawan Regency during an interview. In particular, the Petalawan Malay
customary law community in Pelalawan District, Base Kuras Sub-district,
Kemang Village.
