Penegakan Hukum terhadap Residivis Tindak Pidana Pencurian dengan Pemberatan di Wilayah Hukum Polsekta Tampan

The crime of theft is a crime that is very disturbing in the community, especially the crime of theft with weighting. This makes people feel unsafe in the social environment. The act of aggravated theft is a criminal offense that has been handled many times by the Tampan Sector police.Recidivist perpetrators of aggravated theft are one of the criminal acts handled by the Handsome Sector Police in 2022 which focuses on perpetrators under Article 363 of the Criminal Code in conjunction with 482 of the Criminal Code. A recidivist is a person who commits repeated crimes, criminal acts which have been decided by a court (inkracht van gewijsde). The recidivist perpetrator of aggravated theft was handled by the Tampan Sector Police, the crime of theft was committed at night, theft was committed by 2 people and theft by breaking it using a key which made the perpetrator's actions easier. The problem formulation in this research is: First, how is law enforcement implemented against recidivist perpetrators of theft with weights in the jurisdiction of the Tampan Police. Second: What are the obstacles to the police in carrying out law enforcement against recidivist perpetrators of aggravated theft in the jurisdiction of the Tampan Police. The research carried out is descriptive legal research, which means describing problems that occur in the field by combining legal materials which are secondary data and primary data obtained. The type of research used by the author is a type of research that has an empirical form because the author obtains data based on the research results. The author conducted research directly by visiting the research site to obtain more accurate data based on the problem or research title raised by the author. In this research, the author draws conclusions in an inductive way. Based on the results of research into the crime of theft with weighting, the author found. First, related to the enforcement carried out by the Tampan Sector Police in enforcing the law against recidivist perpetrators, namely in several stages by receiving reports from the public, investigating and inquiring. Second: Related to the obstacles faced by the Tampan Sector Police in dealing with the recidivism of theft by reporting to happen factor internal and factor eksternal.
