Perlindungan Hukum terhadap Konsumen yang Mengonsumsi Obat Penambah Berat Badan (Weight Gain Vitamin)Ditinjau Dari UUD No 8 Tahun 1999 Tentang Alifiah Hidayati
Based on Law Number 8 of 1999 concerning Consumer Protection, article 4 letter a of the Consumer Protection Law (UUPK), consumers have the right to rights to provisions, security and safety when consuming goods/or services. The information is correct, honest and clear regarding the conditions and guarantees for goods/or services. However, there are still many business actors who trade weight gain drugs that contain dangerous ingredients freely, this shows that there is a gap between the laws and regulations governing the reality that occurs in society. The problem in this research is related to legal protection for consumers who consume weight gain drugs that contain chemicals and BPOM in monitoring weight gain drugs containing dangerous ingredients to protect consumers. To obtain data, literature research and field research were carried out. Library research was carried out to obtain secondary data by studying books, laws and regulations, theories related to this research. Field research was carried out to obtain primary data by interviewing respondents. Based on the research results, it shows that consumers are not fully protected by law, especially consumer rights contained in article 4 letter a of Law Number 8 of 1999 concerning Consumer Protection. The public is aware of the dangers of weight gain drugs that are not registered with BPOM, lack of legal awareness, lack of supervision and lack of firm legal witnesses for violators. Legal settlement: Consumers have the right to file a lawsuit against business actors who cause harm to them. In this case, the consumer did not file any lawsuit against the business actor but simply stopped using the weight-increasing drug. It is recommended that business actors carry out their obligations more in accordance with the provisions of the UUPK, especially in article 4 letter a of the UUPK. Apart from that, consumers are advised to be more active in defending their rights. BPOM is advised to further increase supervision and guidance regarding the marketing of dangerous weight gain drugs.
